This section of New York Practice will have a litigation orientation, focusing on those areas of practice, in Supreme Court and County Court, with which the beginning litigator will primarily be concerned: pleadings, commencement of the action, motions, and calendar practice. It will also stress certain other areas where a mistake may prove fatal to the client's case, including service of process and appearances. This course studies how public projects are financed by governments. Issues include: securities law, 10b5 and SEC disclosure requirements, swaps and other derivatives, public purpose, how stadiums are financed, legal authority, general obligation v. revenue bonds, debt limits and how municipal bonds are structured and sold. We discuss topics ranging from the practice of public finance lawyers and investment bankers to the politics of public projects. During the semester, we take an in-depth look at drafting legislation, securities litigation, interest rate swaps and preparing legal opinions and what they mean. No prerequisites, but an interest in finance is helpful. Take home exam.
