This course will provide an introduction to the basic features of, and legal basis for, tribal sovereignty in America, focusing on the issue of jurisdiction in and around tribal nations and their territorial boundaries. It will provide an overview of the history of tribal, federal and state relations and basic foundational principles of federal Indian law. Topics will include criminal and civil adjudicatory jurisdiction in Indian country, regulatory jurisdiction, intergovernmental agreements and recognition of judgments, tribal courts, allocations of jurisdiction and regulatory authority such as the Indian Child Welfare Act, the Indian Gaming Regulatory Act, and the Indian Civil Rights Act.
