Discussion: Tenure rights during layoff and recall, subterfuge and economics necessity, leave and return from leave, definition of incompetency, reasonable and just cause, due process, IDP for tenured teachers, Szopo factors, Professor Kenneth Grinstead's test for terminating a tenured teacher, misconduct outside the school, insubordination, discharge, demotion, and suspension of tenured teachers, timelines and union contract. Student will read, discuss, evaluate and work in groups representing different positions such as the Tenure Commission, school board and administration, as well as the teacher and the union. Several landmark decisions will be discussed.
