This course examines the purposes, advantages, and disadvantages of depositions, the mechanics of taking and defending depositions; planning and scheduling depositions and preparing oneself to take a deposition; taking depositions for use at trial; preparing the witness for deposition; handling the deposition itself; the use of documents at the deposition, the use of stipulations, and other special matters associated with depositions; handling obnoxious or obstructionist opposing counsel, making applications to the Court, and protective orders; reviewing correcting and editing the transcript or videotape of the deposition, and the use of the deposition for summary judgment and at trial; how to defend the deposition; videotape depositions; and expert depositions. This course will be practice-oriented. It will involve the use of real-life examples. The course material will include the use of excerpts from various publications by the National Institute for Trial Advocacy, ATLA, ABA and others. Also included will be a number of helpful articles and commentaries by leading practitioners. Exam. Pass/Fail.
