In this course we will apply the tools of economic analysis to constitutional provisions. We will examin the incentives created by rules, and the likely outcomes. The intent of the course is to consider what is possibly the single most important question: "Is it possible to design a government with the power to protect its citizens, but no the power to oppress them " 1) Analyze a provision or clause of the U.S. Constitution in the context of the intentions of the original framers. 2) Propose a Constitutional provision of your own design and explain its intended, and likely consequences. The later part of the course would be primarily a seminar in which the constitutional provisions under consideration are discussed. The class will also follow developments in the European Union, which is currently experiencing a constitutional moment.
