This course is designed to present the subject of criminal procedure as a construct balancing the power of the government against the competing interests of liberty and privacy of individuals. The central themes of the course will be balancing the interesdt in obtaining the correct result in particular cases against the interest in fair process in all cases; ther requirement of a factual basis to support the actions of law enforcement personnel; and the review of invasions by government officials in the enforcement of the criminal law by the judiciary. This course will seek to set out and establish a deeper understanding and appreciation for criminal procedure and the general principles upon which it rests.
