Description: Special Instructions: Students taking this course may not also take Course #5011, International Commercial Arbitration. This course will cover all facets of arbitration--a dispute resolution process which is being used increasingly in the United States as an alternative to traditional judicial litigation to resolve commercial disputes. Specific areas of practice will include; the arbitration of contractual claims, employment and labor disputes, consumer complaints, construction claims, securities and broker disputes, real estate and banking problems, as well as a wide variety of general commercial and corporate issues. The course will emphasize the familiarity which lawyers must have with respect to the policy, law, practice, procedure, and strategies which relate to arbitral adjudication. Attention will be focused not only on the rapidly developing body of arbitration statutory and case law, but also on the numerous practical aspects of the arbitration process, such as: (1) advising a client in the selection of arbitration as opposed to judicial litigation, (2) drafting arbitration clauses (3) selection of arbitrators, and (4) representing clients in arbitration hearings. The practical aspects of the course will be accomplished through drafting exercises, simulated client counseling sessions, and arbitration proceedings.
