Description: This course considers the various techniques available to resolve disputes among parties, including negotiation, mediation, arbitration, litigation and hybrid alternatives of these. The course will focus on the advantages and disadvantages of these techniques as applied to particular situations, drawing on the theoretical and jurisprudential materials in the field. Attention will also be given to the role of the lawyer in counseling resort to one or more of the various processes, and in designing pre-dispute resolutions systems. The role of the courts and government agencies in creating mandatory, or controlling, dispute resolution systems through statute, regulation or court rule is also examined. The dispute resolution process will be applied in different areas including business, contract and tort law, family law, community problems, and administrative and government regulatory law. Practitioners from government and private practice will discuss their use of dispute resolution in their work. In addition, there will be discussion of the policy and ethical problems presented for the parties, their lawyers, professional intermediaries, and society through resort to these processes. All students will participate in a limited number of simulated dispute resolution exercises and preparation of a dispute resolution document during the course of the semester.
